An obligation to pay restructuring protection fee can arise if the employment contract was terminated due to financial or production-related reasons. This refers to termination based on the work that the employer can offer having diminished substantially and permanently due to financial or production-related reasons or for reasons arising from reorganisation of the employer’s operations. The same rules apply to both private-sector and public-sector employees.

The length of the employment relationship affects the employer’s obligation to pay restructuring protection fee. The employment relationship must have lasted for at least five years. An employment relationship is calculated to have been continuous if there have been no breaks of more than 30 days in total.

The obligation to pay restructuring protection fee depends on the employer’s total payroll (the amount used as the basis for the unemployment insurance contribution) in the year preceding the year of termination.

The year the employment relationship ended cannot be before year 2005.

The restructuring protection fee applies to employers whose payroll, which serves as the basis for the calculation of the unemployment insurance contribution, exceeds the annually specified minimum level. The restructuring protection fee is calculated by the total payroll in the year preceding the termination.

If the company has undergone a merger or mergers prior to the day of termination or during the year preceding the year of termination, the amount of the employer’s restructuring protection fee is calculated based on the combined total payrolls of the merged companies during the year preceding the year of termination.

The amount of the employer’s restructuring protection fee depends on the employee’s restructuring protection allowance. Restructuring protection allowances are paid by the Social Insurance Institution of Finland (Kansaneläkelaitos, Kela) or the employee’s unemployment fund.

The amount of the employee’s restructuring protection allowance is calculated taking into account the employee’s earnings in the employer’s service during the 12 calendar months preceding the date of termination. Only earnings on which the employer has paid an unemployment insurance contribution are taken into account. The amount of the employee’s restructuring protection allowance is calculated by dividing the aforementioned amount by 12.

Only the amount earned in the service of the employer who is now terminating the employee’s contract is calculated in the amount of the restructuring protection allowance. Any amounts that the employee may have been paid by other employers are not taken into account.

The employee’s average monthly earnings are calculated based on their pay during full calendar months. If, for example, the employee’s contract is terminated in June, their pay in May is the last one that is taken into account. The date on which the employee was paid matters and not the period during which the pay was earned. The restructuring protection allowance is calculated based on the employee’s pay over the previous 12 calendar months even if the employee has had unpaid leave during that period.
